1. Scope
These Terms govern the use of the Dwello platform at livedwello.com ("Platform") operated by Dwello, Berlin, Germany. By creating an account or applying for membership you agree to these Terms.
2. Membership
Dwello is a members-only home-swap community. Membership is subject to review and may be declined or revoked at our discretion if quality or safety standards are not met.
3. Hosting & travelling
- Members host other verified members in their home and may earn nights to travel.
- Listings must be accurate and reflect the actual home, location and amenities.
- Members are responsible for compliance with local short-term rental, tax and HOA rules.
4. Fees
Membership and per-night service fees are shown transparently before booking. Cleaning fees, where applicable, are paid directly to the host.
5. Cancellations & refunds
Bookings may be cancelled in line with the cancellation policy displayed at the time of booking. Service fees are refundable up to 7 days before check-in.
6. User content
You retain ownership of photos and text you upload. You grant Dwello a worldwide, royalty-free licence to host, display and promote that content within the Platform and our marketing.
7. Prohibited use
- Discrimination, harassment or unlawful behaviour towards other members.
- Listing properties you are not authorised to rent or host in.
- Off-platform payments or attempts to circumvent Dwello.
8. Liability
Dwello provides the Platform "as is". We are liable only for damages caused by intent or gross negligence, and for damages from breach of essential contractual obligations limited to the foreseeable damage typical of the contract. Statutory liability under the German Product Liability Act remains unaffected.
9. Right of withdrawal (consumers in the EU)
Consumers have the right to withdraw from this contract within 14 days without giving any reason, by emailing hello@livedwello.com.
10. Governing law & jurisdiction
These Terms are governed by the law of the Federal Republic of Germany. The exclusive place of jurisdiction for disputes with merchants is Berlin.
11. Online dispute resolution
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
